Elder law attorney

As the name implies, Elder Law Attorneys specialize in the matters of legal issues for senior citizens.

We have enlisted only those attorneys that have achieved the "Certified Elder Law Attorney" certification ("CELA") by the National Elder Law Foundation. In order to receive such a certification a lawyer must show proficiency, experience, skills and enhanced knowledge in dealing with issues specifically unique to seniors including: health and long-term care planning; public benefits, including Medicaid, Medicare, and Social Security; surrogate decision-making, including powers of attorney and guardianship; older persons’ legal capacity; and the conservation, disposition and administration of the older person’s estate‚ including wills‚ trusts and probate of an estate.

In advising on the above matters‚ the elder law attorney must have a sophisticated tax expertise in addition to the legal issues to be dealt with. Furthermore, prior to certification, the Board of Certification of the National Elder Law Foundation expects elder law attorneys to be capable of recognizing issues of concern that arise during counseling and representation including: abuse, neglect, or exploitation of the senior citizen for insurance, housing, long-term care, employment and retirement.

Finally, the certified elder law attorney must be familiar with professional and non-legal resources and services publicly and privately available to meet the needs of the senior citizen and must be capable of recognizing the professional conduct and ethical issues that arise during representation.
